PRIVACY POLICY

This Privacy Policy governs Te Kōhao Health Ltd’s (“TKH”, “we”, “us” and “our”) collection, use and disclosure of personal information that you may supply to us through your access and/or use of any Te Kōhao Health Ltd service, software, application, product or website.

This Privacy Policy is in accordance with Te Kōhao Health’s Privacy Act 2020 Statement Policy.

Please read this Privacy Policy carefully. By using any of Te Kōhao Health Ltd services and/or providing us with your personal information, you authorise the collection, use, storage and siclosure of your personal information in accordance with this Privacy Policy.

1.        INTRODUCTION

1.1        TKH is committed to protecting your privacy through secure information technology services and complies with the Privacy Act 2020 (Privacy Act), together with the requirements of the Health Information Privacy Code 2020 (or any replacement code of practice or other regulation issued under the Privacy Act).

1.2        Reference to TKH in this Privacy Policy includes any person or organization to which it may licence or assign its rights and obligations.

2.        COLLECTION OF PERSONAL INFORMATION

2.1        We collect personal identifiable information about you from you, when you engage with any Te Kohao Health services. The personal information we collect may include your name, date of birth, e-mail address and physical address.

2.2        We may also collect from you:

Where possible, we will only collect information from you directly and only to the extent that such information is necessary to provide certain services to you and/or your whānau.

2.3        In some situations we may collect someone else’s personal information from you, for example, we may collect your child’s personal information. We may also collect your information from someone else (for example Power of Attorney) where another individual is able to act on your behalf.

2.4        Third parties where you have authorized this or the information is publically available.

2.5        In general, we will let you know at the time of collection whether the provision of personal information to us is optional or required for us to provide you with the best service.

3.        USE OF PERSONAL INFORMATION

3.1        TKH collects and uses your personal information for the following purposes:

  1. to verify your personal information
  2. to provide services and products to you
  3. to market our services and products to you, including contacting you electronically (for example by text or email for this purpose)
  4. to improve the services that we provide you
  5. to conduct research and statistical analysis (on an anonymized basis)

3.2        We will not use personal information for purposes other than described above, unless:

  1. we have your consent or
  2. we are permitted to do so by law

4.        SHARING OR PERSONAL INFORMATION

4.1        We will only disclose personal information in accordance with this Privacy Policy and TKH’s Privacy Act 2020 Statement, in accordance with your specific instructions or authorization. We may disclose your information to:

  1. another entity within our group and any business that supports our services and products, including any person that hosts or maintains any underlying IT system or data centre that use to provide the website or other service and products
  2. other third parties (for anonymous statistical information)
  3. any other person authorised by the Act or another law (e.g. a law enforcement agency) any other person authorised by you
  4. TKH may only disclose personal information to an overseas agency if that

agency has a similar level of protection to New Zealand, or the individual is fully informed and authorises the disclosure.

5.1        We generally hold your information in New Zealand. To the extent we disclose personal information to third parties outside of New Zealand, we will take reasonable steps to ensure such third party is subject to comparable privacy laws as those in the Privacy Act or is otherwise required to protect the information in a way that overall, provides comparable safeguards to those under the Privacy Act.

6.        PROTECT YOUR PERSONAL INFORMATION

6.1        We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other misuse.

6.2        All reasonable steps will be taken to protect unique identifiers from being misused. Unique identifiers are individual numbers, names, or other forms of identification allocated to people by organisations, such as your National Health Index number. It is important that Te Kōhao organisations protect the unique identifiers that they use and only use those that are appropriate for their services to reduce the frequency and impact of identity theft.

6.3        TKH will only retain your personal information for as long as it is needed for the purposes for which it was collected (or any other purpose you have consented to) or for so long as we are required by law to retain it.

7.        YOUR RIGHTS TO ACCESS AND REQUEST CORRECTION OF YOUR PERSONAL INFORMATION

7.1                Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.

7.2        In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction.

8.        CHANGES TO THIS PRIVACY POLICY

8.1        We may occasionally update this Privacy Policy. When we do, we will revise the “last updated” date at the bottom of the Privacy Policy. We encourage you to review this Privacy Policy periodically to stay informed about how we are helping to protect the personal information we collect.

9.        ENFORCEMENT OF THIS PRIVACY POLICY

9.1        TKH must comply with privacy legislation when dealing with personal information.
